What this part of the EU AI Act covers
Section 3 sets out the enforcement regime: the powers and procedures of market surveillance authorities, access to data and documentation, mutual assistance, the procedure for systems presenting a risk, formal non-compliance, and the Union safeguard procedure.
It binds market surveillance authorities and, through them, every operator subject to their powers. It sets out what an authority can demand (access to data, documentation and in some cases source code) and the procedure that follows when a system is found to present a risk.
