What this part of the EU AI Act covers
Section 2 governs serious incidents. Article 73 requires providers of high-risk AI systems placed on the Union market to report serious incidents to the market surveillance authorities of the Member State where the incident occurred, within deadlines that depend on the nature of the incident.
It binds providers, and the deadlines are short enough that the reporting path has to exist before an incident occurs. What counts as a serious incident, and how quickly it must be reported, both depend on the nature of the harm.
