Chapter II: Prohibited AI Practices
Article 5 of Regulation (EU) 2024/1689.
What this part of the EU AI Act covers
Chapter II contains the Act's outright prohibitions. Article 5 lists the AI practices that may not be placed on the market, put into service or used in the Union at all, whatever safeguards are applied. Breaches sit in the highest penalty tier, at up to €35 million or 7% of worldwide annual turnover.
It binds providers and deployers equally, and it admits no compliance route. Where one of the ten prohibitions applies there is no assessment, documentation or consent that makes the practice lawful, which is why screening against Article 5 belongs before any other compliance work rather than alongside it.
